Motorist headed to trial in cyclist's death

cycling, fatalities

A Kenosha County judge ordered Quashae Taylor to be tried on the felony charge of negligence in the death of a cyclist she hit while driving on Aug. 7.

The 18-year-old pleaded not guilty, after the preliminary hearing on Wednesday.

Taylor allegedly closed her eyes shortly before her car struck Devin Kunich on Highway H, near Pleasant Prairie. He was headed home from his job at the Bristol Renaissance Fair and did not have lights on his bike.

The driver told police she did not see Kunich on the road.

She is legally blind in one eye, but an optometrist testified during the preliminary hearing that she is not required to wear eye glasses while driving. Her attorney, Terry Rose, sought a dismissal of the felony charge, arguing that the fatality was an accident not a criminal act.

  1. If you ride at night you need LIGHTS
    otherwise this will happen

  2. While driving downtown today, a goof on a bike rode through a red light and didn't even bother to slow down. In many cases, including car driving infractions, I blame the lack of enforcement.

  3. If you drive you need to keep your EYES open otherwise you become a killer.

  4. I don't see it as a felony here, sounds like an accident to me.

  5. Tom - might as well close the comments now. The same old arguments have already started.

  6. BDWIRunner - I'll keep tabs on them, but I fear you are right. It should be possible to have a discussion, or a debate, without personal attacks or vitriol.

  7. Even though it was an accident, it doesn't seem that the felony charges should be so easily dismissed.
She had been talking on her cell phone, and there is such a thing as criminal negligence.
That said, I'm glad they're going forward with the case, however the facts shake out.

  8. I'd like to know why people think its ok to try and kill cyclists for riding and minding their own business... Why don't motorists know that its legal for cyclists to ride two abreast?? It is legal to ride two abreast. Learn the law.

  9. Sounds to me like both were negligent and should be treated as a accident. He was negligent for riding at night without lights and the driver should have been paying more attention.
